What Are Some Of The Most Common Types Of Civil Cases?

What Are Some Of The Most Common Types Of Civil CasesThe main difference between criminal cases and civil litigation is that, with regard to civil cases, either one or both of the parties are looking to get money or some other type of compensation instead of criminal charges. Generally speaking, in criminal cases, the prosecution represents the state in which the trial is happening, however, in civil cases, the two parties are representing themselves, with the assistance of a legal council or a civil litigation attorney. To give you a better understanding of civil cases, we are going to reveal some of the most common types below. This should help you to understand what these cases involve.

Complaints against the city

The first type of civil litigation case that we are going to take a look at is complaints that have been made against the federal government or the city government. These tend to be settled outside of the courtroom. However, if there is an incident whereby the government will refuse to settle, the complaints are usually going to be tried as civil cases. These sorts of cases can be brought whereby any plaintiff believes that the city policy or the city law has caused harm to citizens. Class action cases

The second type of case that we are going to look at is a class action law case. Class action cases are very much like tort cases, which we will discuss in the next section. However, the difference in these cases is that a class or group of people is going to be represented, and they have all been injured by the same thing. For example, cases that often fall into this category include being exposed to hazardous materials or being injured because of a defective product. However, remember the key here is that more than one people have all been impacted by the same thing. 

Torts

Another example of a civil case is a tort. A tort is a civil litigation case whereby one individual or party has alleged that another person has caused them harm, either emotionally or physically. Tort cases can take a lot of different forms. They can be related to an individual’s monetary security, the safety of their property, and their personal safety. Common torts relate to injury and accident and they can include the likes of battery or assault cases, as well as negligence cases whereby one party has alleged that the caregiver did not do the duty that was assigned to them.

We also have property law, which involves disputes about property damages and ownership to one person’s real estate or property. There are a lot of different types of property disputes that can be handled by a civil litigation lawyer. One of the most common examples in this regard is property line disputes. In this sort of legal dispute, one party will allege that a neighbor has crossed the boundary line for the property in question that goes between their two homes for either planting or building.

Contract disputes

Contract disputes happen when one or more parties who have signed a contract will not or cannot fulfill their obligations. Sometimes, this can happen because the contract has been written in an obscure manner, which has meant that disparate expectations have been created in the signers. However, it tends to be because one of the parties has overextended themselves and does not have the resources, employees, or money to fulfill their obligations.
